Importance of indigenous institutions in democracy

In recent days, the dispute between the government and the Reserve Bank of India has raised some theoretical questions? Some reviewers believe that the government is an elected body, while the RBI. Not so with. The elected body should be dominated by democracy. Partially this argument can be considered true. But in terms of behavior, it can be extremely fatal. All the successful democracies of the world have been dependent on the elected bodies, on the same unrecognized institutions.


The Supreme Court, the Election Commission, and the Army are the well-known institutions of India who hold supreme dignity. Some people also keep the Controller and Auditor (CAG) in this category. On the contrary, the majority of elected leaders consider the masses as fools and robbers.


It does not mean that leaders have no significance. But the fact of the temporary power associated with them is linked. Their elected can not only make them superior to the courts, commissions and the Constitution.


Lalu Yadav also won elections several times after allegations of corruption, and it was said that he was acquitted in the 'public court'. But this is just verbatim. No one is going to decide the crime of any offender. This decision can only be done by an undisclosed judicial process, which does not weigh any culprits with its position and money.


James Madison, one of the makers of the American Constitution, has said that "elected governments can easily become a means of atrocity due to multilateral atrocities or vested interests." They feel that prime independence Meets. It should not be suppressed by temporarily elected people.


Therefore, he has talked about the control of elected governments with strong uninhabited institutions, which may seem attractive in the short run, but which may have fatal consequences in the long run.


The existence of individual rights depends on the similarity to the law established in the constitution. Talking to collective rights is just politics. Most political activities that talk of giving reservation or facilities in the name of religion, caste, sect, etc., can violate personal fundamental rights. The court can stop such activities.

It should be remembered that the Constituent Assembly was also undecided. Does this mean that its legitimacy had come down or its importance reduced compared to the elected institutions? not at all. There was no pressure on this gathering, due to lack of concern about being re-elected. They were equipped with long-lasting policies. So they were not affected by short-term attractions, priorities, and trends.


It can not be denied that the forthcoming elected governments have challenged the Constitution Constituent Assembly by making many amendments in the Constitution. But for every amendment, the consent of the states was also required, with a two-thirds majority in both the Houses of Parliament. This proves that constitutional amendments have been examined at many levels. They were given legitimacy at a great level. This means that it has not tampered for only short-term political gains.


India's top undecided institute is no different from political control. The government has a very important role in the selection of judges, election commissioner, army chief and members of the CAG. These organizations are somewhat responsible for the elected governments.



Some reviewers believe that the constitutional provisions described for the appointment of the Supreme Judge of India have not been given any specific role of government.


But Parliament can impeach me on the Supreme Court judges. Thus their independence is not autocratic.


Together, it can be said that each democracy needs control and balance. To maintain control over the elected government, the country also needs some independent, uninterrupted institutions. On the other hand, there should be political control to maintain accountability of these independent institutions too. Controversy over the power and validity of controlling institutions and maintaining balance is an indispensable and well-being for democracy.


There will be conflicts with different theories. The constitution is a document that will change over time. Every elected government will have to accept the bond before the undisclosed independent institutions.
